General Terms and Conditions (GTC) – MultiDrop GmbH

§ 1 Scope of Application

These general terms and conditions are the basis and part of all goods delivery or purchase contracts between us, the company:

(hereinafter referred to as "MultiDrop"), and private orderers or buyers (consumers) as well as commercial orderers or customers (customers).

• Consumers in the sense of the GTC are any natural persons who enter into a legal transaction for purposes that predominantly cannot be attributed to their commercial or independent professional activity.

• Commercial Customers in the sense of the GTC are natural or legal persons or partnerships with legal capacity that act in the exercise of a commercial or independent professional activity upon entering into a legal transaction.

• Orderers in the sense of the GTC are both consumers and commercial customers.

We ask for your understanding that we only recognize differing conditions from an orderer if we have expressly agreed to them.

§ 2 Conclusion of Contract

• All offers from MultiDrop are non-binding.

• Natural products may have natural deviations in form, color, or weight – these do not constitute a defect.

• By placing an order, the orderer declares that they want to purchase the goods bindingly.

• MultiDrop can accept the contractual offer within two weeks of receipt (in writing or by delivery).

• For electronic orders, access will be confirmed immediately (no automatic acceptance).

§ 3 Delivery / Delivery Times

• MultiDrop strives to deliver ready-to-ship goods within 1–3 business days.

§ 4 Prices / Payment Terms

• Prices are "ex works MultiDrop".

• The statutory value-added tax is included and will be stated separately.

• The orderer bears shipping costs.

• In the case of deliveries outside the EU, German sales tax is waived; import duties are borne by the orderer.

• Payment is due immediately (direct debit or transfer).

• Retention of title until full payment is made.

• Late payment interest:

  
  

  • Consumers: 5% above the base interest rate

  • Commercial customers: 8% above the base interest rate

  
  

§ 5 Transfer of Risk

• The transfer of risk occurs with the handing over of the goods to the buyer.

• If shipped at the orderer's request, the risk transfers upon handing over to the carrier/freight forwarder (except for consumers).

§ 6 Warranty

• MultiDrop delivers free of material and legal defects.

• Natural products may have slight deviations that do not constitute a defect.

• Consumers have the choice between rectification or replacement delivery.

• Warranty periods:

  
  

  • Consumers: 2 years

  • Entrepreneurs: 1 year

  • Used goods: 1 year

  
  

§ 7 Liability Limitations

• Liability for slight negligence is limited to the foreseeable typical damage.

• No liability limitation for:

  
  

  • Product liability

  • Personal injury and health damage

  • Intent or gross negligence

  
  

§ 8 Retention of Title

• Goods remain the property of MultiDrop until full payment is made.

• The customer is obliged to treat the goods carefully.

§ 9 Right of Withdrawal for Consumers

Withdrawal Period:

• 14 days from receipt of the goods.

Withdrawal Declaration:

• In writing (letter, fax, or email) to MultiDrop GmbH, Poller Kirchweg 124, 51105 Cologne.

• Alternatively: model withdrawal form.

Consequences of Withdrawal:

• Refund of all payments including standard delivery within 14 days.

• Refund via the original payment method.

• MultiDrop can refuse reimbursement until the goods have been returned.

• Costs of return shipping are borne by the customer (except when using the provided return label).

No Right of Withdrawal for:

• Custom-made products

• Perishable goods

• Unsealed hygiene products

• Indivisibly mixed goods

• Alcoholic beverages with later delivery

• Unsealed audio/video recordings or software

• Fully performed services with explicit consent

§ 10 Place of Fulfillment / Jurisdiction

• For commercial customers: Jurisdiction is Cologne, Germany.

• German law applies exclusively.

§ 11 Data Protection

• MultiDrop treats personal data confidentially and in accordance with the GDPR.

• Data is only used for contract processing, billing, and internal purposes.

• Customers can object to the use of their data for marketing purposes at any time.

§ 12 Payout of Credit Balances

• A payout only occurs from a minimum amount of €50.

• Amounts below this threshold remain as credit.

• Payouts are made monthly via the payment method specified by the user.
